Negligence case headed to civil court

Motorists in Texas who have suffered serious injuries in a car accident due to the fault of another driver may be interested in hearing about a local personal injury lawsuit that has been filed. According to media sources, three Jefferson County residents are seeking damages in connection with a two-car crash that occurred in Nederland. The suit was filed at the Jefferson Division Courthouse on May 27.

Two defendants are named in the lawsuit: the driver believed to be responsible for the car accident and the owner of the vehicle involved in the crash. Negligence has been cited as a factor in the distracted driving accident.

In the complaint, the plaintiffs claim that the allegedly negligent driver’s inattention to surrounding traffic, failure to control the speed of her vehicle and failure to yield the right of way resulted in the crash, causing the plaintiffs to be injured. In addition to damages in accordance with the evidence, the plaintiffs are also seeking court costs and interest in the civil suit.

The complaint reveals that the plaintiffs are represented in the case by a Port Arthur attorney. San Antonio residents who are considering the pursuit of financial compensation for losses suffered in an auto accident may also find it beneficial to seek legal counsel. An attorney could examine the case evidence and establish liability of all responsible parties as well as determine the full extent of the client’s loss. In some situations, the attorney may be able to negotiate a fair settlement with insurance companies outside of court. However, if the claim cannot be settled, the attorney may be able to file a lawsuit and successfully argue the case in the civil courtroom.
